Others speak no French and find the buying process in France rather daunting.
As a matter of course, we will help you with submitting your offer, we will accompany you to the
Notaire’s office, if requested, and we will fully explain the property buying process in France.
We can help with arranging utility connection, household insurance, bank accounts, mortgage providers
and currency brokers. We will be happy to put you in touch with letting agents, local tradesmen, plumbers,
builders etc. and just as importantly we can proffer advice on life in France – schools, doctors etc.

Conveyancing
|

This is the legal term for processing the paperwork involved in buying and selling property and transferring
the deeds of ownership.

Notaire
|
|
|
| |
In France, conveyancing is strictly governed by French law and can only be performed by a public
notary authorized by the Ministry of Justice. A notaire represents neither the buyer nor the seller,
but the French government, and his primary role is to ensure that all state taxes are paid on
completion of a sale. Notaires follow a strict code of conduct and have personal insurance
covering their professional responsibility and guaranteeing clients against any errors that they may make.
The vendor’s notaire normally acts for both the vendor and buyer, but the buyer can insist on using his own
notaire. It does not cost the buyer anymore to engage his own notaire, as the notaires work together and
share the same fee. The notaire is also responsible for all searches. |

Notaire’s Fee

The notaire collects purchase taxes for the French government. These are calculated on a sliding scale based
on the value of the property, excluding contents. Including the Notaire’s fee for conveyancing, the total
is normally about 6-7% of the purchase price, excluding contents |

Mortgage Fee

These are normally about 1% of the value of the mortgage. |
|
|
| |
Compromis de Vente
|
|
|
| |
This is the preliminary contract to be signed when purchasing a house in France. At this
point a deposit of 10% of the purchase price will be lodged with the notaire. Once signed
the compromis de vente is a legally binding document between all parties. It is at this
stage in the process that any conditions /clauses suspensives can be added to the contract.
The buyer has 7 days following the signing to change his mind with full refund of his deposit
or add any further conditions of sale. |

Acte de Vente

| |
This is the completion of the purchasing process. The balance of the purchase price and the
Notaire’s fee must be paid to the notaire, prior to signing the final act. Like the compromis
de vente, both buyer and seller are present, unless someone has been appointed to sign by proxy.
The acte de vente is then held at the Notaire’s office for safe-keeping. |

Tax

There are 2 taxes related to property ownership in France. The taxe d’habitation
is payable by anyone who lives in a property in France on the 1st January of each
year be they the owner, tenant or living in the house rent-free. The taxe fonciere
is a property tax similar to rates. It is payable on property and land. |

Insurance

| |
Buildings insurance is the responsibility of the new owner immediately on completion. |
